The 2014 Building Control Regulations provide that new single dwellings on a single unit development would not be the subject of mandatory certification requirements. The Owner can opt out of the certification requirements by filing a Declaration of Intent to opt out at the same time as filing a Commencement Notice. Hence there will be two forms of certification depending on whether an Owner has opted out or not. If an Owner has opted out a Purchaser may have genuine concerns as to the quality of work carried out in the building. The attitude of Lending Institutions when giving Loans may also be affected. If a Lending Institution insists that an Owner does not opt out of the Certification regime, that will have a significant impact on how subsequent Buyers will view a property.
